This website, located at www.inaturewatch.org or any of our site including mobile applications, is provided by iNaturewatch Foundation (INW). The terms 'We'/ 'Us'/ 'Ours'/ 'Foundation'  individually and collectively refer to iNaturewatch Foundation and the terms 'Visitor' 'User” “You” “Yours” refer to the users the person accessing this site.Your access to, and use of, this Site is subject to the following Terms of Use. By accessing and using the Site, you accept these Terms of Use.

This page states the Terms and Conditions under which you (Visitor) may visit this website (“Website”). Please read this page carefully. If you do not accept the Terms and Conditions stated here, we would request you to exit this site. The iNaturewatch Foundation, any of its divisions reserve their respective rights to revise these Terms and Conditions at any time and without notice, by updating this posting. Your continued use of the Site constitutes your acceptance of any such revisions. You cannot modify these Terms of Use. You should visit this page periodically to re-appraise yourself of the Terms and Conditions, because they are binding on all users of this Website.

2. USE OF CONTENT

The information and materials on this Site are provided for general informational purposes. You may use this site solely for the purpose of finding out about and/or purchasing INW services and products. All logos, brands, marks headings, labels, names, signatures, numerals, shapes or any combinations thereof, appearing in this site, except as otherwise noted, are properties either owned, or used under license, by the business and / or its associate entities who feature on this Website. The use of these properties or any other content on this site, except as provided in these terms and conditions or in the site content, is strictly prohibited. You may not use, reproduce, or distribute the text, graphics, downloads, tools, or any other content on this Site for any other purpose.You may not sell or modify the content of this Website or reproduce, display, publicly perform, distribute, or otherwise use the materials in any way for any public or commercial purpose without our written permission. Any suspected fraudulent, abusive, or illegal activity may be referred to appropriate law enforcement authorities.

3. ACCEPTABLE WEBSITE USE

i. Security Rules

Visitors are prohibited from violating or attempting to violate the security of the Web site, including, without limitation, (1) accessing data not intended for such user or logging into a server or account which the user is not authorized to access, (2) attempting to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without proper authorization, (3) attempting to interfere with service to any user, host or network, including, without limitation, via means of submitting a virus or 'Trojan horse'.  to the Website, overloading, ;'flooding', & 'mail bombing'& ; or ;'crashing';, or (4) sending unsolicited electronic mail, including promotions and/or advertising of products or services. Violations of system or network security may result in civil or criminal liability. The foundation and / or its associate entities will have the right to investigate occurrences that they suspect as involving such violations and will have the right to involve, and cooperate with, law enforcement authorities in prosecuting users who are involved in such violations.

ii. General Rules

Visitors may not use the Web Site in order to transmit, distribute, store or destroy material (a) that could constitute or encourage conduct that would be considered a criminal offence or violate any applicable law or regulation, (b) in a manner that will infringe the copyright, trademark, trade secret or other intellectual property rights of others or violate the privacy or publicity of other personal rights of others, or (c) that is libelous, defamatory, pornographic, profane, obscene, threatening, abusive or hateful.

4. PRODUCT/PROGRAMME INFORMATION

We make every effort to display as accurately as possible our products and services. In the event that a product is mistakenly listed at the wrong price or with incorrect specifications, INW reserves the right to refuse or cancel any orders placed for product listed incorrectly, whether or not the order has been confirmed and your credit card charged. If your credit card has been charged for the purchase and your order is cancelled, INW shall issue a refund to your account in the amount of the incorrect price charged. In no event shall INW be obligated to provide you the merchandise at the incorrect price.Prices are subject to change at any time without notice.

The colours shown on the Site may be influenced by the settings of your computer or your monitor. Accordingly, INW makes no guarantees that any colours of products or features will be true or accurately reflect the colour of the product on delivery. All sizes and measurements are approximate.

Products/Programmes are subject to availability. There is a delay between the time an order is placed/booked and the time the order/booking is accepted, therefore the stock levels/seats available relating to particular items/event may change. If an item you have ordered/booked becomes out of stock before we accept your order, we shall notify you as soon as possible.

5. ORDERING, CANCELLING AND RETURNING PRODUCTS/PROGRAMMES

i. Contract creation

The products/programmes purchased on this Site are for private and domestic use only and are not for re-sale. Any orders placed by you will be treated as an offer to purchase the goods or services from us and we have the right to reject such offers at any time. Rejection of an order may be the result of one of the following:

 The product/programme you ordered/booked is out of stock/unavailable

 We have been unable to authorize payment

 There was an error with the price or product/programme description

 You did not meet the eligibility criteria set out in our Terms & Conditions.To create the contract between you and us the following steps are followed:

 You place the order for our products/programmes on our Site by selecting the order confirmation button at the end of the checkout process

 We will send an order confirmation email detailing the products you have ordered. This does not constitute acceptance of the order

 Your order/booking will be delivered/confirmed to you by an email. Order acceptance and the completion of the contract between you and us takes place on the dispatch of your order from our end unless we have rejected the order or you have cancelled it

 Your credit/debit card will be charged when your order is dispatched, unless you are paying via CCAvenue in which case you will be charged immediately. If there are any problems with your order we shall contact you.

The contract will be concluded in English. The details of your specific contract will not be filed by us so please print and retain a permanent copy of the Conditions.

You will assume the risk for any Products purchased/programme booked by you once they have been delivered to the delivery address which you specified during the checkout process when you placed the order. We accept no liability where you provide an incorrect delivery address or where you fail to collect the Products from the delivery address which you specified at checkout.

6. PAYMENT

All cardholders may be subject to validation checks and authorization by the card issuer. If the issuer of your payment card refuses to or does not, for any reason, authorize payment to us, we will not be liable for any delay or non-delivery. We do not accept payment by cheque, cash or demand draft and postal orders. If for some reason a purchase fails, due to problems with payment details, we will attempt to contact you by email or phone. We will take all reasonable care to keep the details of your order and payment secure, but in the absence of negligence on our part we cannot be liable for any loss you may suffer if a third party procures unauthorized access to any data provided by you when accessing or ordering from the Site.

i. Delivery

All orders are processed immediately and are dispatch on clearance of payment - usually within 3-4 days, depending on the time of receipt and stock availability. We reserve the right to vary the standard shipping charges on certain items which are unusually high in weight, volume or value. Notice of an additional delivery charge is displayed on the product information page for products that fit into any one of these categories listed. We will contact you to advise on what the additional charge will be prior to shipping.

ii. Returns and refunds of Products: Please note that the product once sold will not be taken back. There will be no refunds made. In case if you have received a faulty product, you need to send it back to us at our office in Kharghar, Navi Mumbai within a week’s time and we will send you a replacement. Please note that we will not be liable for the courier or postal charges for the same. If you wish to send an item, please send to the address below, obtaining a proof of posting note from the Post Office or courier service as we cannot be held responsible for any items not received by us:

As soon as the item is received by us and checked, we will initiate replacement process. We will dispatch the replacement product within 7 working days time. However we will not be responsible if there is a delay in reaching of the product to you.

iii. Programme Cancellation and Refunds: 

First, we would like to encourage you to simply move to next session/walk. However, we understand that things come up and you may need to cancel all together.

In that case, please call or email us Kindly note the following:

 7 days until the program start date, 10% of the program fees will be chargeable as cancellation fees.

 2 days prior to the program start date, 50% of the program fees will be chargeable as cancellation fees.

 If you don't show up at the program, entire program fees will be forfeited.

7. PROGRAMME DISCLAIMER

In case of any accident/mishap during our programme which is beyond the limits of the organizers, the iNaturewatch Foundation or any of its partners/associates will not be held responsible. Participants will be participating in our programmes on their own risk. Children need to be always accompanied by adults. 

8. INTELLECTUAL PROPERTY

You agree that all copyrights, trademarks and all other intellectual property rights in the material and content of this Site shall remain vested in us or our licensed partners. You acknowledge and confirm that the material and content contained within the Site is made available for your personal non-commercial use only. Any other use of the material and content of this Site is strictly prohibited.

9. LIMITATION OF LIABILITY

Notwithstanding our reasonable endeavours to verify the accuracy of the information appearing on this Website, we make no express or implied warranties in relation to its accuracy. We make no warranty that the Site will meet your requirements or will be uninterrupted, timely or error-free, that defects will be corrected, or that the Site or the server that makes it available are free of viruses or bugs or represents the full functionality, accuracy and reliability of the Website. We will not be responsible or liable to you for any loss of content or material uploaded or transmitted through the Site. So far as the law allows, we shall not be liable to you for any other loss or damage whatsoever.  Your statutory rights as a consumer and your cancellation rights are not affected by these Conditions. Nothing in these Conditions shall exclude or limit our liability for death or personal injury resulting from our negligence or that of our employees or agents.

User agrees that neither Foundation nor its trustees, directors, officers or employee shall be liable for any direct or /and indirect or/and incidental or/ and Special or/and consequential or/and exemplary damages, resulting from the use or/and the inability to use the service or/and for cost of procurement of substitute goods or/and services or resulting from any goods or/and data or/and information or/and services purchased or/and obtained or/and messages received or/and transactions entered into through or/and from the service or/ and resulting from unauthorized access to or/and alteration of user's transmissions or/and data or/and arising from any other matter relating to the service, including but not limited to, damages for loss of profits or/and use or/and data or other intangible, even if Foundation has been

advised of the possibility of such damages.

User further agrees hat Foundation shall not be liable for any damages arising from interruption, suspension or termination of service, including but not limited to direct or/and indirect or/and incidental or/and special consequential or/and exemplary damages, whether such interruption or/and suspension or/and termination was justified or not, negligent or intentional, inadvertent or advertent.

User agrees that Foundation shall not be responsible or liable to user, or anyone, for the statements or conduct of any third party of the service. In sum, in no event shall Foundation's total liability to the User for all damages or/and losses or/and causes of action exceed the amount paid by the User to Foundation, if any, that is related to the cause of action.

10. WAIVER

Any delay or failure on our part to exercise our rights under these Conditions shall not be construed as a waiver of any prior or subsequent breach by you of any provision.

11. INDEMNITY

The User unilaterally agree to indemnify and hold harmless, without objection, the Foundation, its officers, directors, employees and agents from and against any claims, actions and/or demands and/or liabilities and/or losses and/or damages whatsoever arising from or resulting from their use

of www.inaturewatch.org or their breach of the terms.

12. SEPARATE CONDITIONS

If any part of these terms and conditions is held to be unlawful, void or unenforceable for any reason, it shall not affect the remaining provisions of the Conditions which shall remain in full force and effect.

13. GOVERNING LAW

The laws of India shall govern the contract between us and any dispute between us will be resolved

exclusively in the courts of India.
